The opponents of Wal-Mart’s planned expansion of its Rohnert Park store into a much larger “supercenter” claimed victory Thursday afternoon, after a court ruling upheld their contention that the Environmental Impact Report for the project was insufficient in two key areas.
“We just received a favorable ruling from Judge Chouteau on the Rohnert Park Wal-mart Supercenter case,” reported Martin Bennett of the Living Wage Coalition in an email to KRCB. “According to our lawyer, he granted the writ petition, finding the EIR's traffic mitigation and noise analysis violated CEQA. [the California Environmental Quality Act, which governs the EIR process]. He upheld the greenhouse gas emissions analysis, however.”
As a result Bennett said, “The city will need to re-do the two defective EIR sections.’
The Wal-Mart opponents have scheduled a 1 pm news conference in front of the Rohnert Park City Hall Friday afternoon to elaborate on the judgment.
